Nagelprobe EUGH: Die Stellungnahme der EU-Kommission zum TUI-Fall. Ein kritischer Kommentar

Abstract

Der renommierte Göttinger Rechtswissenschaftler Prof: Dr. Rüdiger Krause bezweifelt massiv, dass die Rechtsposition der EU-Kommission zum anhängigen sog. TUI-Fall am EuGH haltbar ist. Er sieht in seiner Stellungnahme zum Fall keine rechtlichen Gründe dafür, dass ein EU-Mitgliedstaat bestimmte Wahlrechte in der Mitbestimmung auf sein nationales Territorium beschränkt. Würde der EuGH dieser Argumentation folgen, würde nicht nur in Deutschland, sondern in vielen anderen EU-Mitgliedstaaten die Arbeitnehmerbeteiligung im Aufsichts- oder im Verwaltungsrat von Unternehmen gefährdet. Die Rechtsunsicherheit würde für Unternehmen wie für Arbeitnehmer zunehmen.
