Nagelprobe EuGH: Mitbestimmung untergraben oder festigen?

Abstract

- Der EuGH hat, auf der Grundlage einer Vorlagefrage eines deutschen Gerichts darüber zu entscheiden, ob die bestehenden Gesetze zur Arbeitnehmerbeteiligung in Unternehmensorganen bzw. ihre Anwendung mit dem Europarecht vereinbar sind. - Je nach dem, wie die Entscheidung des EuGH ausfällt, drohen erhebliche Verwerfungen der nationalen Systeme der industriellen Beziehungen in allen Mitgliedstaaten. Das Verfahren hat folglich erhebliche Bedeutung über Deutschland hinaus. - Die Regierungen der EU-Mitgliedstaaten können sich an Verfahren vor dem EuGH mit eigenen Stellungnahmen beteiligen. - Die nationalen Gewerkschaftsbünde sollten prüfen, ob es unter den genannten Gesichtspunkten sinnvoll ist, bei ihren nationalen Regierungen für die Abgabe einer eigenen Stellungnahme zu werben.
