Die Behandlung von Preisschirmeffekten bei der Bestimmung von Kartellschäden und Mehrerlösen

Abstract

In den letzten Jahren weisen sowohl die Zahl der aufgedeckten Kartellverstöße als auch die verhängten Bußgelder eine stark ansteigende Tendenz auf. Bei der Bemessung schadensorientierter Bußgeldbeträge, aber auch bei der Bestimmung möglicher Kartellschäden in sich inzwischen häufig anschließenden Schadensersatzprozessen, erlangt die Frage nach der Behandlung von Preiserhöhungen nicht am Kartell beteiligter Unternehmen als Reaktion auf die Kartellpreisbildung zunehmende Bedeutung. In der vorliegenden Arbeit werden die verschiedenen Erklärungsansätze derartiger Preisschirmeffekte untersucht und unter besonderer Berücksichtigung der gerichtlichen Entscheidungen in Sachen "Kone" und "Flüssiggas" Folgerungen für die Behandlung des Themas in der Rechtspraxis abgeleitet.
