Der Einfluss von Gerichtsentscheidungen auf Regulierungsreformen

Abstract

In diesem Beitrag wird die Rolle von Gerichtsentscheidungen im regulatorischen Reformprozess anhand wegweisender Gerichtsentscheidungen näher betrachtet. Solche Gerichtsentscheidungen sind von besonderem Interesse, da sie nicht nur Konflikte zwischen den streitenden Parteien, sondern auch wesentliche Lücken im bestehenden Regulierungsrecht aufzeigen. Ausgehend vom Bronner-Urteil wird das Problem der Lokalisierung netzspezifischer Marktmacht untersucht. Anhand des Guernsey Transport Board Urteils wird die Entwicklung des Sekundärhandels mit Flughafenslots beleuchtet. Darauf aufbauend wird dargestellt, dass generell die Märkte für Netzinfrastrukturkapazitäten nicht durch gesetzlich verordnete Regulierungsvorschriften verzerrt werden dürfen.
