La gestione dei rifiuti da apparecchiature elettriche ed elettroniche dopo la direttiva 2002/96/CE

Abstract

Lo smaltimento dei rifiuti è uno dei principali problemi che le economie moderne debbono affrontare. In questo lavoro si è studiato il caso di una particolare categoria di rifiuti, quelli generati dalle apparecchiature elettriche ed elettroniche dismesse (RAEE), che sta da qualche tempo crescendo a ritmi molto veloci. Per questo, i RAEE sono stati oggetto di una direttiva europea che, in analogia alla direttiva 2000/53/CE relativa ai veicoli a fine vita, definisce una serie di obblighi e di obiettivi in materia di raccolta e recupero. La direttiva 2002/96/CE introduce inoltre il principio fondamentale della responsabilità individuale dei produttori per la gestione dei rifiuti derivanti dai loro prodotti, con la finalità di promuovere generazioni future di apparecchiature più compatibili con l’ambiente. La traduzione di principi, obiettivi ed obblighi generali in regole dettagliate ed incentivi mirati spetta alle regolamentazioni nazionali. Per fare ciò nel migliore dei modi occorre per prima cosa definire i confini del problema e della situazione attuale sul fronte della raccolta e del recupero con le sue potenzialità di sviluppo. Congiuntamente, occorre studiare i comportamenti dei soggetti a cui si rivolge la nuova normativa per capire come potrebbero reagire alle nuove regole ed ai nuovi incentivi. L’analisi comparativa delle regolamentazioni in corso di definizione in Francia, Regno Unito ed Italia mette in luce il diverso approccio di fondo a cui le amministrazioni si ispirano e lascia intravedere i modelli verso cui esse spingono l’organizzazione del settore. Il caso della California è una cartina tornasole che offre i primi riscontri empirici dei comportamenti assunti e dei risultati ottenuti con regole ed incentivi nuovi in materia di rifiuti da apparecchiature elettriche ed elettroniche .
