Finanças públicas e a vitória do rentismo no Brasil: o novo regime fiscal dos financistas (EC 95)

Abstract

This article seeks to clarify central points of the situation of public finances in Brazil, to identify the main budgetary expenses and the real financial problems of the Brazilian State in order to be able to accurately qualify the nature of the "New Fiscal Regime" (NRF). It seeks to answer if the NRF is a solution to the existing problems in public finances and state management, or if, in fact, it reflects the institutional consolidation of the hegemony of rentier system on the affairs of this same State, aggravating the mistakes of the Law of Fiscal Responsibility (LRF) and constituted an institutional framework far below the guiding principles of this law and of the Federal Constitution of 1988 (CF/1988). It is considered that the rentier system framed the relationship of the Central Bank with the Treasury, and the NRF comes to support the mechanism of debt generation, being the most evidence of this, the freezing of budgetary expenses does not occur on the expenses that relate with the monetary policy and the Central Bank. Instead resolving the problem of public finances - recovering revenues and reducing financial expenses and their generating factors - and sustaining the modus operandi of the Treasury and Central Bank, the NRF indicates the preference for the second, at the cost of constitutional rights, reflecting the hegemony of the rentier system on the citizenship.
