Abstract

Резюме: В българското осигурително законодателство няма легално определение на понятието „осигурителноправен спор”. По принцип правното понятие за „спор” е доктринално и затова законодателят се въздържа да го определя в правна норма. Поради това понятието „осигурителноправен спор” следва да се изгради на основата на общото учение за споровете в правото и чрез характеристика на специфичните белези на спора в осигурителното право, извлечени чрез анализ на тяхната правна уредба. В настоящата статия се изследват най-общите въпроси на теорията на осигурителноправните спорове, като отделните техни аспекти следва да бъдат предмет на отделно научно изследване.
