Abstract

Резюме: Статията анализира разпоредбите на чл. 110-113 от Закона за здравето, с които се въведоха промени в процедурата за обжалване на актовете, постановявани от органите на експертизата на работоспособността. Критиката на автора е насочена към кръга от субекти, които имат право да обжалват актовете на тези органи. Аргументира се тезата, че сроковете за административно и съдебно обжалване на тези актове са преклузивни. Авторът посочва законодателното несъвършенство на нововъведеното отклонение в хода на административното обжалване на актовете, които са постановени във връзка с експертизата относно временната неработоспособност.
