Abstract

Резюме: От началото на 2000 г. до сега се извърши поетапно и прогресивно (с някои изключения в регресивна насока) кодифициране на правната уредба на общественото осигуряване в България. Осигурителното право като самостоятелен отрасъл в единната българската правна система не е кодифицирано. Това е така, защото преди всичко самият Кодекс за социално осигуряване изключва от своя предметен обхват обществените отношения в здравното осигуряване, и на второ място, защото и в рамките на своя предмет той не урежда изчерпателно всички основни отношения, които се поддават на трайна правна уредба. Редица важни въпроси са уредени в други закони и в подзаконови нормативни актове, а някои все още не са получили своята правна уредба. Това означава, че законодателят продължава да бъде в дълг към българското общество в посока на по-нататъшното кодифициране на правната уредба на общественото осигуряване, и изобщо на българското осигурително право.
