Le développement jurisprudentiel de l’obligation de mise en garde du banquier

Abstract

La responsabilité du banquier est sujette à de fréquentes évolutions. C’est ainsi que l’obligation de conseil du professionnel s’est vue substituée, récemment, par un devoir de mise en garde. Celui-ci évoqué implicitement, comme explicitement, par un certain nombre de décisions depuis une vingtaine d’années, a été affirmé par plusieurs arrêts de la première chambre civile de la Cour de cassation du 12 juillet 2005. Ces derniers suscitent cependant encore des controverses quant au contenu à attribuer au devoir de mise en garde, même s’il demeure possible de proposer une définition conceptuelle du contenu du devoir en question. Néanmoins, au-delà de cette incertitu- de, le développement de l’obligation de mise en garde a pour intérêt de répondre efficacement au besoin de protection des plus faibles en présence d’opérations risquées, sans pour autant être attentatoire, à la différence du devoir de conseil, au principe de non-ingérence, c’est-à-dire une norme de comportement essentielle pour le banquier.
