Abstract
Default is a term that refers to the non-performance of achievements by the debtor. The occurrence of a default causes the other party (the opponent of the party to default) to be harmed. Due to a loss by another party, the party that has defaulted must bear the consequences of the opposing party's demands which can be in the form of: Cancellation of the agreement; cancellation of the agreement accompanied by a claim for compensation; fulfillment of the agreement and fulfillment of the agreement accompanied by demands for compensation. force majeure or what is often referred to as a "force majeure" which is a condition in which a person is regulated to be hindered from carrying out his achievements due to unexpected circumstances or events at the time the contract was made, the situation cannot be held accountable to the debtor, while the debtor is not in bad mood Wanprestasi adalah suatu istilah yang menunjuk pada ketiadalaksanaan prestasi oleh debitur. Terjadinya wanprestasi mengakibatkan pihak lain (lawan dari pihak yang wanprestasi) dirugikan. Karena adanya kerugian oleh pihak lain, maka pihak yang telah melakukan wanprestasi harus menanggung akibat dari tuntutan pihak lawan yang dapat berupa : Pembatalan perjanjian; pembatalan perjanjian disertai tuntutan ganti rugi; pemenuhan perjanjian dan pemenuhan perjanjian disertai tuntutan ganti rugi. force majeure atau yang sering disebut sebagai “keadaan memaksa” yang merupakan suatu keadan di mana seseorang diatur terhalang untuk melakukan prestasinya karena keadaan atau peristiwa yang tidak terduga pada saat dibuatnya kontrak, keadaan tersebut tidak dapat dimintakan pertanggung jawaban kepada debtur, sementra si debtur tidak dalam keadaan beritikad buruk
