Abstract

Peninjauan kembali pada dasarnya adalah upaya hukum luar biasa yang disediakan untuk semata-mata melindungi kepentingan terpidana, bukan kepentingan negara atau korban dalam rangka mencari kebenaran materiil. “Peninjauan Kembali yang disingkat PK adalah suatu upaya hukum yang dipakai oleh terpidana untuk memperoleh penarikan kembali atau perubahan terhadap putusan hakim yang pada umumnya tidak dapat diganggu gugat lagi. Peninjauan kembali merupakan upaya hukum terhadap putusan tingkat akhir dan putusan yang dijatuhkan di luar hadir tergugat (verstek), dan yang tidak lagi terbuka kemungkinan untuk mengajukan perlawanan.
