Abstract

Penelitian ini bertujuan mengetahui Bagaimana metode pembuktian al-qasamah terhadap kasus pembuktian pembunuhan, apakah pembuktian al qasamah ini dapat menjadi alat atau bukti untuk pembuktian hukum ketika tidak diketahuhi pelakunya. Misalnya dalam kasus pidana pembunuhan yang tidak adanya saksi dan tidak diketahui pelakunya. Penelitian ini merujuk pada metode analisis dekstriftif yang berasal dari sumber sumber Hukum Pidana Islam., Meski metode pembuktian Al qasamah tersebut berasal dari zaman jahiliyah pra islam. Islam mengakui metode pembuktian al-qasamah adalah dalam rangka menjaga, melindungi, dan menghargai jiwa manusia. Maka dari itu metode Al qasamah ini dapat menjadi alat untuk membuktikan kebenaran sehingga para pelaku pembunuhan dapat diketahuhi dan para korban tidak teraibaikan hak yang telah dirampas begitu saja
