Abstract

Artikel ini membahas tentang zina dalam perspektif Islam dan KUHP. Dengan menggunakan metode analisis komparatif ditemukan perbedaan antara Hukum Islam dan KUHP dalam mendefenisikan istilah zina serta konsekuensi hukumnya. Hubungan seksual antara pasangan muda-mudi tidak dikategorikan sebagai perbuatan zina dalam KUHP karenamereka tidak sedang berada dalam ikatan perkawinan yang sah.KUHP juga tidak menjerat pelaku zina yang tidak tunduk pada pasal 27 BW meskipun sedang berada dalam ikatan perkawinan yang sah. Selain itu jika suami atau isteri pelaku zina memberikan izin kepada pasangannya untuk berbuat zina, maka pasal 284 tidak dapat menejratnya. Sementara dalam pandangan Hukum Islam, setiap hubungan seksual di luar ikatan perkawinan yang sah dikategorikan sebagai perbuatan zina
