Abstract

Disini membahas tentang penjualan barang bermerek palsu secara online. Dengan menjual barang tiruan pada toko online seperti Shopee dapat menimbulkan kerugian kepada masyarakat dengan membeli barang palsu yang di jual oleh pelaku usaha secara online.Dengan adanya.peniruan barang branded menjadi barang tiruan merupakan pelanggaran bagi pelaku usaha karna menjual suatu produk dengan logo yang sudah terkenal (branded) dan menjualdengan harga yang lebih rendah dari harga aslinya tanpa meminta izin dari pemilik merek (brand).Karya ilmiah ini menggunakan metode yuridis normatif,dengan menggunakan pendekatan perundang-undangan. Kesimpulan yang bisa ditarikdalam pembahasan ini yaitu perlindungan hukum terhadap konsumen serta sanksi pelakuusaha yang menjual barang bermerek palsu secara online diatur di dalam Undang-UndangNomor 8 tahun 1999 tentang Perlindungan Konsumen, Peraturan Pemerintah Nomor 82Tahun 2012 Tentang Penyelenggaran Sistem dan Transaksi Elektronik, serta Undang-Undang Nomor 15 tahun 2001 tentang Merek.
