Abstract

Le présent Rapport sur la place des contrats régissant les flux transfrontières de données dans le cadre plus général des mécanismes de protection de la vie privée sur les réseaux mondiaux a été rédigé sous la supervision du Secrétariat. Il se fonde sur l'engagement pris par les gouvernements des pays Membres de l'OCDE, lors de la Conférence d'Ottawa de 1998, "Un monde sans frontières : concrétiser le potentiel du commerce électronique mondial", d’encourager l'utilisation et le développement de solutions contractuelles types pour les flux transfrontières de données en ligne, et de veiller à ce que soient disponibles des mécanismes efficaces d’exécution permettant, d’une part, de résoudre les problèmes de non respect des principes et des politiques de protection de la vie privée et, d’autre part, de garantir l’accès à des moyens de réparation.
