Fundamentos de la precariedad. Discursos legitimadores de la reforma laboral en Argentina (2017-2018)

Abstract

En esta ponencia se analiza el proyecto de Reforma Laboral (130/2017) elevado por el Poder Ejecutivo en noviembre de 2017. En sus fundamentos se destacan las transformaciones acaecidas en el mundo del trabajo desde la sanción de la Ley de Contrato de Trabajo (1974) hasta el presente, como argumento central para explicar la necesidad de introducir las modificaciones normativas propuestas. Si bien la desprotección laboral vinculada a la informalidad, la tercerización, la sub y la sobre ocupación constituyen hechos precedentes a la propuesta normativa, aquí se sostendrá que la propuesta, lejos de dar respuesta a estas problemáticas, tendería a profundizarlas mediante su legitimación normativa. En la ponencia se abordarán tres aspectos de la propuesta: la judicialización, la tercerización y la regulación del tiempo de trabajo. Se dará atención al diagnóstico del mercado laboral en que se fundamentan las propuestas, contrastando con datos empíricos provenientes de otras investigaciones. De este análisis se concluye una proyección de las posibles consecuencias en el mercado de trabajo y en las condiciones de protección jurídica de los trabajadores, lo que permitirá valorar los alcances y riesgos de su posible implementación.
