Treu und Glauben: Frag GPT

Abstract

Die Juristen haben eine gespaltene Beziehung zu Treu und Glauben. Es soll gerecht zuge-hen. Deshalb sollen treuwidrige Entscheidungen vermieden werden. Aber für den offenen Rückgriff auf normative Wertungen haben Juristen keine spezifische professionelle Kom-petenz. Dieser Beitrag macht aus der Not eine Tugend. Er interpretiert Treu und Glauben als das Gebot, grob unfaire Ergebnisse zu vermeiden, und schlägt so eine Brücke zur Ver-haltensökonomie. Vor allem bietet er aber eine Methode an, um diese Interpretation im konkreten Fall nutzbar zu machen. Das Sprachmodell GPT kann Rechtsanwender darüber informieren, wie eindeutig die konkrete Entscheidung gegen Treu und Glauben verstoßen würde.
