Le sanzioni amministrative per le banche italiane: effetti sulle performance (prima parte)

Abstract

La ricerca indaga l’efficacia dell’azione di vigilanza e analizza le motivazioni e gli effetti che le sanzioni amministrative emanate dalla Banca d’Italia hanno avuto sulla performance delle banche italiane. Tale argomento sembra assumere una particolare rilevanza in un periodo quale quello attuale contraddistinto da una crisi finanziaria ed economica i cui contorni risultano essere ancora totalmente indefiniti. Considerando che il sistema bancario e' uno dei settori economici maggiormente vigilati e con i piu' alti costi di compliance, ci si trova probabilmente di fronte alla necessita' di una profonda rivisitazione della mission del sistema stesso sia relativamente al ruolo dell’Autorita' di Vigilanza che al ruolo stesso dell’operatore creditizio. Sara' particolarmente interessante nei prossimi mesi verificare se il sistema sanzionatorio esistente e le sanzioni erogate negli anni antecedenti all’esplosione della crisi siano stati sufficienti o abbiano quantomeno contribuito a preparare meglio gli operatori a fronteggiare le difficolta' che stanno affrontando in questi ultimi mesi ovvero, paradossalmente, denotino la necessità di rivedere il frame sanzionatorio generale. Al fine di monitorare questo fenomeno e' stato recentemente costituito un Osservatorio con l’obiettivo di supportare lo studio attraverso un’accurata ricerca e analisi di dati e informazioni confluiti in un database comprendente la totalita' delle sanzioni amministrative emanate dalla Banca d’Italia dal 1998 al 2010 (in progressivo e continuo aggiornamento). L’analisi delle sanzioni e' stata condotta congiuntamente all’analisi delle performance delle banche sanzionate prima e dopo la sanzione.
