Abstract
O aumento dos preços agrícolas atingiu níveis alarmantes a partir de 2007, o que caracterizou o fenômeno da “agroinflação”. Com os preços dos alimentos em expansão e a expectativa de forte crescimento populacional para os próximos anos, a questão da aquisição de terras por estrangeiros no mundo vem chamando a atenção, especialmente em regiões africanas e latino-americanas. No Brasil, a aquisição de terras por estrangeiros cresceu desde 2008. Esse aumento levou a Advocacia Geral da União (AGU), em 2010, a reinterpretar a legislação até então vigente, no intuito de limitar o acesso de estrangeiros à propriedade fundiária nacional. O debate acerca da aquisição de terras por estrangeiros é controverso. Não há dúvida de que é preciso monitorar a inserção estrangeira na economia, o que pode ser feito via registro e atualização dos dados. Além disso, deve-se ter cautela com os investimentos de fundos soberanos de países com forte interesse na importação de produtos primários brasileiros. Todavia, é importante lembrar que o Estado pode regular o mercado mesmo com uma legislação mais flexível ao investimento estrangeiro. Palavras-chave: agricultura; legislação; aquisição de terras. The rise in agricultural prices to alarming levels since 2007 characterized the “agrinflation” phenomenon. Because of the increase in food prices and the expectation of strong population growth in the coming years, the issue of land grabbing by foreigners in the world has been drawing the attention, especially in African and Latin American regions. In Brazil, the land grabbing by foreigners has increased since 2008. In 2010, this increase has led the General Attorney of the Union (AGU) to reinterpret the Brazilian legislation of land acquisition, in order to limit the access to Brazilian landed property by foreigners. The debate about land grabbing by foreigners is controversial. There is no doubt about the importance of monitoring the integration of foreigners in Brazilian economy, which can be done by registering and updating data from land acquisition data. Moreover, there should be caution in terms of investments from sovereign wealth funds from countries with strong interest in importing Brazilian primary products. However, it is important to mention that the state can regulate the market even with a legislation that is more flexible to foreign investments. Keywords: agriculture; legislation; land grabbing.
