Abstract
O objetivo do texto é apresentar a trajetória de elaboração do Estatuto da Igualdade Racial, instituído pela Lei no12.288/2010. Para tanto, o foco da narrativa é a tramitação legislativa dos projetos de lei (PLs) que iniciaram a matéria, por meio de análise documental. Como síntese do relato das diversas alterações sofridas nos PLs, a narrativa sobre a tramitação é concluída com quadro resumo das principais propostas descartadas ao longo dos dez anos de tramitação e daquelas aprovadas e presentes na referida lei. Em seguida, é apresentada avaliação sobre o debate público em torno da aprovação do estatuto, finalizando com uma reflexão sobre encaminhamentos e desafios para a política de promoção da igualdade racial com a instituição desse novo marco legal. Conclui-se que a lei dispõe de configuração bastante distante das proposições iniciais e das aspirações por medidas concretas e efetivas de promoção da igualdade racial. Todavia, em que pese essas constatações, avalia-se que há espaço para regulamentação e construções políticas que permitam avanços no campo da redução das desigualdades raciais. The aim of this paper is to introduce the drafting development of the Racial Equality Statute, established by Law 12.288, of 2010. However, the focus is on the proceedings of the legislative bills which initiated the matter, through the documentary analysis support. As a summary of the bills` changes reported in the paper, the narrative is finished with an outline of the main proposals discarded over ten years of proceedings and those approved and present in the Act. Moreover, an evaluation about the public debate around the Statute approval is featured, ending with a reflection on the prospects and challenges for racial equality policy according to this new legal framework. It is concluded that the law final text is very far from the original proposals and efforts concerning concrete and effective measures to promote racial equality. However, despite these findings, it is estimated that there are conditions for regulatory and political constructions that allow advances in reducing racial inequalities.
