La réforme électorale au Burundi: un commentaire du projet de Code électoral

Abstract

Après la réforme constitutionnelle du 7 juin 2018, le Burundi s’apprête à une réforme de sa législation électorale en vue des élections générales de 2020. En janvier 2019, le Conseil des Ministres a adopté un projet de loi portant révision du Code électoral du 3 juin 2014. Le premier objectif de cette réforme est de conformer la législation électorale au nouveau texte de la Constitution. Afin d’encourager le débat sur la réforme électorale, ce working paper offre une analyse du projet de loi. Les auteurs mettent l’accent sur la conformité du projet de loi avec la Constitution du 7 juin 2018, avec les traités internationaux en matière des droits de l’homme qu’a ratifiés le Burundi et avec l’Accord d’Arusha pour la Paix et la Réconciliation au Burundi du 28 août 2000. Quelques lacunes et problèmes sont identifiés et, en guise de conclusion, quelques voies de solutions sont suggérées.
