Transparencia dinámica: Una auditoría de la Ley de Libertad de Información de México

Abstract

El objetivo de las Leyes de Libertad de Información (FOIAs, por su sigla en inglés, Freedom of Information Acts) consiste en facilitar un intercambio canalizado entre ciudadanos y funcionarios públicos que, independientemente de la identidad del ciudadano, tiene como resultado el suministro de información oportuna, pertinente y a menudo nueva acerca de las políticas públicas. Los autores de este documento evaluaron la FOIA de México presentando 307 peticiones de información en nombre de un ciudadano común a entidades públicas en los años 2007, 2013 y 2015. En 2007, los autores también presentaron las mismas solicitudes a 87 entidades comparables en nombre de un ciudadano que aparentaba tener influencia. En la mayoría de los casos, las entidades no discriminan entre ciudadanos regulares y aparentemente influyentes. Las entidades también están respondiendo más frecuentemente y proporcionando más información en 2015 en comparación con años anteriores, pero tardan más tiempo en responder, y a menudo cobran una tarifa y no entregan información de calidad para responder a preguntas que están legalmente obligadas a responder. La FOIA de México es un sistema funcional que exige mejoras importantes.
