Asimetrías cruzadas o cubismo normativo: La incorporación de normas en el MERCOSUR

Abstract

La problemática de este artículo es de identificar las consecuencias del modelo de incorporación de normas sobre la efectividad del derecho del MERCOSUR, revelando un "cruzamiento" entre las distintas asimetrías que existen en el bloque. La primera parte del texto, dedicada a los elementos sistémicos de la cuestión, demuestra que el problema principal de la incorporación de normas no es la asimetría constitucional entre los Estados miembros: aunque un mecanismo que podría dispensar la incorporación de normas figure en la letra fría de sus Constituciones, Argentina y Paraguay jamás han puesto en práctica dicho instrumento. La segunda parte del artículo se dedica a los elementos de coyuntura, a fines de probar que el sistema "comunitario" de incorporación es generador de un verdadero mosaico normativo, marcadamente asimétrico, al hacer predominar distintos elementos nacionales sobre la perspectiva de una seguridad jurídica en el plan regional. Versiones preliminar es de este artículo fueron presentadas en sendos workshops coordinados por el BID sobre "Deeper Integration of MERCOSUR: Dealing with Disparities", realizados en Washington D.C. y en Río de Janeiro, en los meses de febrero y julio de 2005.
