Abstract

The issue of algorithmic collusion has given rise to an extensive literature since the publication of Ariel Ezrachi and Maurice Stucke's seminal book Virtual Competition in 2016. This contribution aims to present this literature but also the competition-law procedures conducted on this basis. It distinguishes between situations in which algorithms support anti-competitive practices that would exist independently of them and those in which they initiate tacit patterns of collusion. It looks at the regulatory tools available to prevent such risks and presents new potential collusive schemes, in this case agreements based on generative artificial intelligence and algorithms-based adversarial collusion strategies.
