Abstract

La gestion des prélèvements d'organes est souvent considérée, dans la littérature scientifique, comme une illustration d'un système fondé sur le don. Toutefois, le système français de transfert des organes est un ensemble complexe de règles d'organisation, dont les fondements théoriques semblent parfois peu cohérents et ambigus. La non-rémunération des personnes prélevées suffit-elle à considérer le transfert d'organe comme un exemple de transfert unilatéral et volontaire ? A travers les analyses économiques du don, proposées par Collard (1981) et Kolm (1984), nous souhaitons évoquer quelques unes des principales divergences entre un système de transfert d'organes construit à partir de la théorie économique de l'altruisme, et le système actuel de transfert d'organes en France. Cette comparaison a pour principal objectif d'expliciter les fondements de la gestion française actuelle des prélèvements d'organes.
