La complexité du droit douanier dans les RUPs Caribéennes : Cas de la Guadeloupe et la Martinique

Abstract

La fonction douanière est une fonction importante pour réguler les échanges. Pourtant en France, celle-ci ne possède pas son code particulier mais trouve sa source dans différents textes de lois. Si ce fait crée déjà une complexité en soi, la position des RUPs Françaises et notamment la Guadeloupe et la Martinique est encore plus délicate. C'est ce que nous nous attarderons à explorer au travers de cet article. En effet, les RUPs sont généralement des territoires insulaires faisant preuve d'une forme de vulnérabilité et bien souvent d'une complexité dans les échanges. Nous chercherons donc à voir si le droit douanier est un outil complexe et efficace pour les entreprises de ces RUPs et en particulier pour les achats.
