Abstract

Cet article examine la manière dont les blockchains constituent une forme de contestabilité (au sens de Baumol) du marché de la conservation des titres. La fonction notariale dévolue aux dépositaires centraux de titres est aujourd'hui menacée par de nouveaux entrants qui peuvent contester la position jusque-là monopolistique de ces acteurs de place. L'article pointe la façon dont l'industrie du post-marché (compensation, règlement-livraison et conservation) est appelée à se transformer pour répondre à la concurrence exercée par des acteurs issus des fintech faisant appel aux registres délégués qui permettent de prendre en charge l'ensemble des fonctions logistiques de la chaîne de traitement des valeurs mobilières.
