Abstract

Born in the United States under the influence of the neoclassical school, New public management (NPM) has permeated public policies in France since the mid-1990s, breaking with the conception of the Welfare State. Since the law of January 2, 2002, the legal framework for regulating the social and medico-social sector illustrates this strong shift in social policies, through the articulation of the mechanisms contained in Book III of the Code de l'action sociale et des familles (Code of Social Action and Families). To comprehend the ambivalence of these instruments and understand the causes of the paradox between liberalization and reconcentration of powers by the French State, it is useful to recall the genesis of the NPM, the circumstances which governed its adoption in France and its consequences for social and medico-social establishments and services.
