Abstract

Le Digital Markets Act proposé le 15 décembre 2020 par la Commission européenne vise à fournir des outils complémentaires à ceux dont elle dispose au titre de l'application des règles de concurrence. Il ne s'agit pas ici de poursuivre un objectif d'efficacité (dont le critère du bien-être du consommateur pourrait être une matérialisation) mais de garantir la contestabilité des marchés et l'équité et la loyauté de la concurrence sur ces derniers. Cette contribution montre pour quelles raisons la concurrence pour le marché peut être plus difficile à garantir sur les marchés dans lesquels sont actives les grandes firmes du numérique et pour quelles raisons la concurrence dans le marché peut être biaisée par leur puissance économique.
