Abstract

Le nom de domaine peut constituer un instrument promotionnel non négligeable en identifiant non seulement l'entreprise, mais également les produits ou services de celle-ci. Il est en effet courant d'enregistrer des noms de domaine correspondant à des produits pour tenir informé le consommateur sur les caractéristiques ou évolutions de ces produits. Au-delà de cette utilisation commerciale du nom de domaine, il est important de s'interroger sur sa valeur juridique. Cette étude a pour but de répondre à cette question, afin de permettre aux titulaires de noms de domaine de connaître la portée et les limites juridiques conférées par ce nouvel instrument de communication.
