Abstract

Débuté en octobre 2013 avec le vote de la loi sur la concurrence, le processus de mise en œuvre du droit calédonien de la concurrence devait s'achever, quatre ans plus tard, avec la nomination attendue des membres de son autorité de concurrence en juillet 2017. Mais, contre toute attente, le Congrès a alors refusé de valider les nominations proposées par le gouvernement. Retour sur un vote surprenant, dont les craintes qu'il faisait peser sur la naissance de la première AAI calédonienne viennent heureusement d'être levées avec la nomination de ses membres, finalement réalisée en décembre.
