Faut-il renforcer la répression du stationnement frauduleux ?

Abstract

Dans le cadre de la politique de modération de l'usage de la voiture en ville, l'action sur le stationnement a un rôle privilégié. Une des interventions plébiscitées par les pouvoirs publics est la tarification du stationnement sur voirie qui ne doit cependant son efficacité qu'au respect de la législation par les usagers. Or, un des dysfonctionnements de la politique du stationnement est la persistance d'un niveau de fraude considérable. Face à un tel constat, l'augmentation de l'amende est généralement présentée comme une solution radicale pour dissuader les fraudeurs. L'objectif de cet article est de montrer qu'il n'existe aucune réflexion économique solide permettant de légitimer cette proposition. Les résultats théoriques d'une analyse économique du comportement de fraude au stationnement payant relativisent par ailleurs les vertus du renforcement de la répression.
