De la difficile caractérisation des abus d’exploitation sur les marchés de gros de l’électricité

Abstract

Le 18 juillet 2014, le Collège de l'Autorité belge de la concurrence a sanctionné Electrabel, filiale du groupe GDF-Suez, à une sanction pécuniaire de deux millions d'euros pour un abus de position dominante sur le marché de la production, de la vente de gros et du négoce de l'électricité Il s'agit d'un cas rare, dans la pratique décisionnelle des autorités de concurrence européennes, d'une sanction pour abus d'exploitation d'une position dominante. En l'espèce, l'opérateur historique du marché belge de l'électricité a été sanctionné pour avoir pratiqué des marges excessives (de l'ordre de 60 €/MWh) dans le cadre de la vente d'une partie de ses réserves de capacités sur la bourse de l'électricité Belpex DAM. Ce commentaire illustre les difficultés dans le cas d'espèce - relatif à la réserve tertiaire - mais également dans le cadre général pour caractériser économiquement et juridiquement de tels abus sur les marchés de l'électricité.
