Abstract

L'article analyse le processus de décision européen dans le domaine des politiques de l'environnement. Il oppose les stratégies de « dumping écologique » destinées à traiter les activités industrielles par le principe du moins disant écologique et celles de « protectionnisme vert » visant, au contraire, à ériger des normes de niveau élevé afin de donner aux entreprises nationales un avantage dès lors qu'elles les maîtrisent au départ. L'article met en évidence comment les interactions entre lobby et représentants institutionnels des Nations, dans le cadre des règles institutionnelles communautaires, conduisent à l'élaboration de politiques de « dumping écologique » ou de « protectionnisme verts ». On montre ensuite comment les modalités et les délais de transposition des directives ou la répartition des rôles entre les différents niveaux de compétence sont utilisés comme instrument de stratégie par les lobbies et les Etats pour imposer des normes environnementales qui les avantagent.
