Abstract

L'excès et la complexité de la réglementation française est régulièrement pointée du doigt dans les rapports publics et les études des organismes internationaux. Sont notamment dénoncées la lourdeur des procédures de création d'entreprises et la réglementation excessive de certains marchés et professions, qui constitueraient des obstacles à la concurrence pesant sur la croissance économique. La question est pourtant, plus épineuse qu'elle ne paraît. Car si une réglementation inappropriée peut en effet entraver la concurrence et nuire à l'économie, elle répond aussi généralement à des défaillances du marché, notamment à des asymétries d'information qui pénalisent le consommateur, et préservent la qualité du service rendu. Trois exemples au cœur du débat public - les professions juridiques, les taxis et la distribution des médicaments - illustrent ce dilemme
