Une confrontation de trois modèles de mariage à partir de l'analyse des transferts ordonnés lors du divorce

Abstract

Quels sont les déterminants du montant des transferts ordonnés par les juges au moment où les couples divorcent ? La relation qui peut exister entre les caractéristiques des divorçants, les conditions de leur divorce et le montant des transferts alors ordonnés peut éclairer la représentation que les juges et, à travers eux la société, se font du mariage. L'article analyse cette relation à partir d'informations concernant 1681 divorces prononcés en 1986 dans six tribunaux français, et de trois modèles de mariage, dont les conséquences en termes de transferts au moment du divorce sont explicitées.
