Abstract

L'objectif de cet article est de savoir si les marchés liés à Internet nécessitent un traitement spécifique de la part des autorités de la concurrence. A travers la présentation d'une série de décisions récentes au niveau français et communautaire, il s'agit de dégager les principaux défis posés par Internet en matière de politique de la concurrence. Ces défis portent sur l'appréciation des pratiques concertées et des accords très nombreux sur les marchés Internet. De même, comment les autorités doivent-elles traiter les situations de position dominante dès lors que les marchés Internet sont propices à la monopolisation ? Enfin, le troisième défi concerne l'examen des projets de fusion sur des marchés Internet qui sont le plus souvent émergents et incertains. Face à ces défis, c'est moins le droit de la concurrence qu'il faut changer que la manière d'appliquer ce droit, les marchés Internet exigeant de la part des autorités une plus grande prudence et souplesse que les marchés traditionnels
