Approche économique des accords de report d’entrée dans l’industrie pharmaceutique

Abstract

La récente confirmation en appel par la Cour de justice de l'Union européenne de la décision Lundbeck de la Commission européenne en 2013 marque le terme d'une des principales procédures liées aux accords de report d'entrée dans l'industrie pharmaceutique. Après une présentation de l'environnement réglementaire dans lequel ces accords ont été abordés en Europe et aux Etats-Unis -notamment à la suite de la décision Actavis de la Cour suprême en 2013 -nous commentons une approche économique qui met l'accent sur les incitations des entreprises à conclure de tels accords, ainsi que sur leurs effets sur le bien-être collectif. Nous évoquons aussi des enseignements plus généraux, issus d'études récentes de ces accords, et qui contribuent à l'analyse de la concurrence sur les marchés de médicaments.
