Barèmes d’indemnisation et licenciement, quel bilan ?

Abstract

L'une des ordonnances du 22 septembre 2017 a consacré un barème déterminant l'indemnité que doit verser l'employeur à un salarié lorsqu'il le licencie sans cause réelle et sérieuse, ou abusivement. Ce barème s'impose aux juges qui condamnent l'employeur à indemniser le salarié injustement licencié. Le niveau d'indemnisation est désormais strictement encadré. La somme pouvant être versée est soumise à un plancher et à un plafond. L'objectif de notre étude est d'abord de mettre en évidence les conséquences de l'application, mais aussi de la non-application, du barème d'indemnisation des licenciements sans cause réelle et sérieuse. En effet, si le barème d'indemnisation des licenciements abusifs est appliqué, quelles sont les réelles incidences en matière d'embauche ? Or, sans que l'embauche ne soit facilitée, on assiste à une ineffectivité du barème et corrélativement à une instabilité des décisions de justice affectant les relations entre employeurs et salariés.
