Abstract

In this chapter, I describe how exclusive IP Rights and non-exclusive Intellectual Commons (the Public Domain) can be both inclusive and extractive institutions depending on their institutional design. Then, I focus on the conditions necessary for the emergence of a more inclusive Global Public Domain and I describe some of the existing issues that prevent it. I conclude by providing some public policy suggestions to minimise these problems.
