Abstract

Suivant une approche pluridisciplinaire, cet article analyse l'attention que la Loi ESS 2014 a porté à l'entrepreneuriat social associatif et à la contribution sociopolitique dont les associations sont potentiellement le creuset. A contrario du droit européen, la Loi 2014 ne reconnait pas la catégorie économique d'entreprise sociale tout en envisageant les propriétés entrepreneuriales de l'Association. Quant à la dimension sociopolitique de l'Association, la loi fait abstraction du principe de réciprocité, l'expression juridique des espaces publics de proximité et des processus de co-construction des politiques publiques manquant de consistance.
