Abstract

Quelles conséquences d'un retour de la gestion de l'eau potable en régie publique ? Outre le fait que cette question s'inscrit dans l'actualité des retours en régie de grandes collectivités (paris en 2009, nice en 2014 et montpellier en 2016), elle renvoie surtout à des enjeux pour le pilotage et le contrôle organisationnels. Le processus de retour en régie de la gestion de l'eau entraîne un profond bouleversement de l'équilibre entre « contrôle-confiance » habituellement constaté dans le cadre des relations entre une collectivité (autorité organisatrice de la gestion de l'eau) et un délégataire privé. Le passage en régie permet à la collectivité d'accorder une part plus importante à la confiance qu'elle octroie à son exploitant. Toutefois, pour que ce nouvel équilibre puisse s'opérationnaliser, le développement de formes de coopération entre la collectivité et sa régie est nécessaire.
