Les lois chinoises de blocage : miroir des lois d’extraterritorialité américaine et triangulation stratégique

Abstract

Les États-Unis ont développé tout un arsenal de lois dites extraterritoriales, depuis les années 70. Avec la montée en puissance du Foreign Corrupt Practice Act (FCPA), à partir des années 90, ces lois sont devenues des armes de guerre économique, qui ont connu un apogée dans les années 2000. Elles ont joué, en effet, un rôle important dans les combats économiques que se livrent la Chine et les États-Unis, depuis plusieurs décennies, avec un pic sous la mandature de Trump. À son tour, en 2021, Pékin a diffusé deux textes dont l'objectif affiché était de contrecarrer les lois américaines. Dans un environnement économique et normatif, de plus en plus dense et compétitif, il convient d'analyser en profondeur ces lois de blocage, car c'est, potentiellement, le prélude au déploiement de mesures plus offensives. Bien en saisir leur portée, c'est mieux comprendre les stratégies juridiques, économiques et géopolitiques chinoises qui impacteront le management des entreprises européennes.
