Abstract

L'extension de compétence du Parquet National Financier portée par le projet de loi relatif au Parquet européen et à la justice pénale spécialisée pourrait sensiblement dynamiser un volet jusqu'alors délaissé des politiques de concurrence. Si les problématiques qu'il ravive trouvent partiellement des éléments de réponse dans la Directive ECN+ dont la transposition devrait intervenir d'ici le 4 février 2021, le projet invite en réalité à une réflexion plus globale quant à la place des contentieux pénal et administratif, leur articulation et les sanctions qui les accompagnent.
