Abstract

On January 24, 2023, a hearing was held at the Administrative Court of French Polynesia in the case of the appeal against Order No. 654 CM of May 6, 2022 amending the regulatory part of the Competition Code. The public rapporteur recommended the cancellation of two important provisions which aim to reinforce the power of action of the president of the Polynesian Competition Authority (PCA) over the investigation department, at the risk of harming the separation of the investigation and decision functions. 1. A brief review of recent developments in the Competition Code 2. Two provisions of the order should be cancelled 3. Interest to act and (im)possibilities of action 4. Disciplinary power and appeal against dismissal 5. What are the prospects in the current context?
