Abstract

Adoptée en août 2016 après trois recours à l'article 49.3 de la Constitution, la réforme du Code du travail portée par Myriam El Khomri a suscité un conflit social majeur et de profondes divisions politiques. Répondait-elle à un problème public ? Comment son contenu a-t-il été décidé et légitimé ? Quelles sont les trajectoires des acteurs ayant produit le « projet de loi Travail » ? Pourquoi celui-ci est-il devenu l'enjeu d'une vive controverse ? Pour répondre à ces questions, ce livre combine deux méthodes d'enquête. D'une part, une analyse des discours publics des membres du gouvernement et d'une série d'articles et de rapports d'experts. D'autre part, la réalisation d'entretiens avec des acteurs clés et des témoins du processus de production du projet de loi, parmi lesquels plusieurs anciens membres du cabinet de Myriam El Khomri. Les questions abordées concernent plusieurs sciences sociales. Mais ce livre intéressera aussi le citoyen surpris par l'imposition autoritaire d'une réforme du Code du travail qui ne figurait pas au programme du candidat Hollande. L'ouvrage éclaire également la réforme menée en 2017 par Emmanuel Macron, et le projet de société porté par ce dernier.
