Abstract

Relire la controverse entre Smith et Bentham sur l'usure à l'aune de la question du bonheur permet d'apporter des réponses aux difficultés tant de l'analyse de Smith que de celle de Bentham. C'est ce que nous proposons de montrer, en abordant, dans un premier temps, la question des interactions entre règles formelles – la loi – et règles informelles, puis dans un second temps, en appliquant ce cadre d'analyse à l'analyse que les auteurs propose du marché du crédit.
