Abstract

L'extraterritorialité du droit est un concept ambigu qui remet en cause la souveraineté des États, et par conséquent les bases du droit international, en permettant à un État d'agir unilatéralement sur le fondement d'une de ses lois internes, sur le territoire d'un autre État.La RPC s'est dotée, début 2021, d'un dispositif juridique permettant de lutter contre l'application extraterritoriale de la législation étrangère, quand celle-ci n'a pas fait l'objet d'un accord ou traité international auquel la Chine serait partie. Les entreprises européennes transnationales, confrontées à ces dilemmes juridiques, ne sont pas prêtes à pouvoir arbitrer entre le respect des lois américaines et les contre-mesures chinoises. Le texte chinois pourrait être difficile à appliquer si l'Union européenne (UE) et les États-Unis s'alignaient sur une posture commune et forte. A contrario, la Chine pourrait profiter de la vulnérabilité de l'Europe, qui fonde une large part de son PIB sur le commerce (40 % en 2019),
