Abstract

La loi de finances pour 2022 a habilité le Gouvernement à agir par voie d'ordonnance pour réformer la responsabilité des ordonnateurs. En exigeant que la répression des fautes de gestion soit confiée à la Cour des comptes au lieu de la CDBF, elle apporte une louable réponse à l'insuffisance des moyens du juge des ordonnateurs depuis 1948. La responsabilité répressive des ordonnateurs est-elle pour autant en mesure de connaître un réel essor et de devenir moins confidentielle ? Les principes essentiels définis par la loi affaiblissent la portée du futur régime de responsabilité et le vouent à demeurer modeste, même si certains facteurs d'équilibre peuvent être envisagés.
